SEALED PROPOSALS FOR THE WORK DESCRIBED AND SHOWN ON THE PLANS ENTITLED:
CITY OF LOMPOC, CALIFORNIA; CONSTRUCTION PLANS, FOR, 2012 STREET REHABILITATION PROJECT, ON CENTRAL AVENUE, NORTH AVENUE, SAN MIGUELITO WATER SERVICE ROAD, BAILEY PARK WATER SERVICE ROAD, LAUREL STREET.
will be received at the OFFICE OF THE CITY CLERK, Lompoc City Hall, 100 Civic Center Plaza, Lompoc, California 93438-8001, until Bid Opening Date of 2:00 p.m. Thursday, August 22, 2012, at which time they will be publicly opened and read at the same address.

PART B; PROPOSAL AND SAMPLE CONTRACT FOR 2012 STREET REHABILITATION PROJECT.
GENERAL WORK DESCRIPTION: Roadway excavation and reconstruction; cold planning surface of existing asphalt concrete pavement; furnishing, spreading and compacting rubberized asphalt concrete ARHM; furnishing, spreading and compacting asphalt concrete; preparation of subgrade for portland cement concrete (PCC) and asphalt concrete; adjusting of utility lids to grade; finish grading; clean-up.
CONTRACT DOCUMENTS: Contract Documents (Plans, Notice to Contractors, Special Provisions, Proposal and Sample Contract) or other related information, are available for review at the Engineering Counter, City Hall building, 100 Civic Center Plaza, Lompoc, CA 93438.
Contract Documents for bidding this project may only be obtained at The Office of the City Treasurer which is located at 100 Civic Center Plaza, Lompoc, California 93438, for a non-refundable fee as shown on cover of the Project Manual. Use FAX (805) 736-5347 to expedite orders for Contract Documents. FAX orders must include credit card charge number, card expiration date and authorizing signature. QUESTIONS PERTAINING TO THIS PROJECT PRIOR TO AWARD OF THE CONTRACT SHALL BE DIRECTED TO: City of Lompoc, Engineering Division, 100 Civic Center Plaza, California 93438; Attention: Michael Luther, Telephone (805) 875-8272.
PROPOSALS: Proposals are required for the entire work described in the Contract Documents. Proposals will not be considered unless they are made on the proposal forms furnished with Project Manual - Part B. Attention to prospective bidders is called to Section 2, "Proposal Requirements and Conditions," within Project Manual - Part A, for full direction as to bidding, etc. The City of Lompoc reserves the right to reject any or all proposals or make the award to the lowest responsible bidder.
BONDS: Each proposal must be accompanied by cash, a certified or cashier's check, or bidder's bond of the prescribed form and made payable to the City of Lompoc for an amount equal to at least ten percent (10%) of the amount bid, such guaranty to be forfeited, should the bidder to whom the contract is awarded fail to furnish the required bonds and to enter into a contract with the City within the period of time provided by the Proposal Requirements. Each proposal shall include a Payment Bond per Civil Code Section 3248. The bond shall be in a sum not less than one hundred percent of the total amount payable by the terms of the contract.
LICENSE REQUIREMENTS: In accordance with provisions of California Public Contract Code Section 3300, the City has determined that the Contractor shall possess a valid Class A license at the time of award. The Contractor shall be properly licensed at the time the contract is awarded. No contract will be awarded from a Contractor who has not been licensed in accordance with the provisions of Chapter 9 of Division 3 of the Business and Professions Code.
STANDARD SPECIFICATIONS: The Standard Specifications for this project are contained in the 2009 edition, including all supplementary pamphlets, of the Standard Specifications For Public Works Construction ("Greenbook"), as written and promulgated by the Joint Cooperative Committee of the Southern California Chapter of the American Public Works Association and the Southern California District of the Associated General Contractors of California. Copies of the Standard Specifications are available from the publisher, Building News, Incorporated, 10801 National Boulevard, Los Angeles, California 90064, Telephone (800) 873-6397.
PREVAILING WAGE RATES: Pursuant to Section 1773 of the Labor Code, the general prevailing wage rates in the County of Santa Barbara, in which the work is to be done have been determined by the Director of the California Department of Industrial Relations. These wages are set forth in the General Prevailing Wage Rates for this project, available at the City of Lompoc address and available from the California Department of Industrial Relations’ Internet web site at http://www.dir.ca.gov. The Federal minimum wage rates for this project as predetermined by the United States Secretary of Labor may be examined at the offices described above where the Contract Documents may be seen. Addenda to modify the Federal minimum wage rates, if necessary, will be issued to holders of Contract Documents. Future effective general prevailing wage rates, which have been predetermined and are on file with the California Department of Industrial Relations are referenced but not printed in the general prevailing wage rates.
Attention is directed to the Federal minimum wage rate requirements in the Contract Documents. If there is a difference between the minimum wage rates predetermined by the Secretary of Labor and the general prevailing wage rates determined by the Director of the California Department of Industrial Relations for similar classifications of labor, the Contractor and subcontractors shall pay not less than the higher wage rate. The City will not accept lower State wage rates not specifically included in the Federal minimum wage determinations. This includes "helper" (or other classifications based on hours of experience) or any other classification not appearing in the Federal wage determinations. Where Federal wage determinations do not contain the State wage rate determination otherwise available for use by the Contractor and subcontractors, the Contractor and subcontractors shall pay not less than the Federal minimum wage rate, which most closely approximates the duties of the employees in question.
CITY STANDARD REQUIREMENTS: The City of Lompoc Standard Requirements For The Design and Construction Of Subdivisions and Special Developments are available from the City of Lompoc, Public Works Department, 100 Civic Center Plaza, Lompoc, California, 93438 at a cost of $20.00 per set.
DISADVANTAGED BUSINESS ENTERPRISES: The City of Lompoc hereby notifies all bidders that it will affirmatively insure that in any contract entered into pursuant to this advertisement, disadvantaged business enterprises will be afforded full opportunity to submit bids in response to this invitation and will not be discriminated against on the grounds of race, color, or national origin in consideration for an award.
RETENTION: The Contractor may elect to receive 100 percent of payments due under the Contract Documents from time to time, without retention from any portion of the payment by the City, by depositing securities of equivalent value with the City in accordance with the provisions of Section 22300 of the California Public Contract Code. Such securities, if deposited by the Contractor, shall be valued by the City, whose decision on evaluation of the securities shall be final. Securities eligible for investment under this provision shall be limited to those listed in Section 22300 and Section 16430 of the California Government Code.
ENGINEER’S COST ESTIMATE: The Design Engineer has calculated an estimate of probable construction costs for this project. The City does not wish to publicize the engineer’s estimate of the project cost since this information may tend to influence the number and nature of bids received. However, for bidder’s convenience, the City will publicize that the engineer’s estimate for the base bid falls within a range of $900,000-$1,000,000.
PRE-BID CONFERENCE: A pre-bid conference will not be held for this project.
